Why it matters now
- Family Law Act s 4AB: family violence includes behaviour that "coerces or controls" a family member.
- Since 6 May 2024: safety from family violence is the first matter a court considers for a child's best interests (s 60CC(2)(a)).
- Since 10 June 2025: courts must consider the effect of family violence in property settlement (s 79(4)(ca) & s 79(5)(a)).
- NSW: coercive control offence in force from 1 July 2024.
- Queensland: coercive control offence in force from 26 May 2025.
